This policy explains how TexMed Health collects, uses, discloses, retains, and protects personal information through its websites, applications, and related services.

THIS POLICY IS NOT A HIPAA NOTICE OF PRIVACY PRACTICES. If a Notice of Privacy Practices applies to particular health information or clinical services, that separate notice controls those uses and disclosures.

1. Scope
This Privacy Policy describes the practices of TexMed Health, LLC (“TexMed,” “we,” “us,” or “our”) for personal information processed through websites, portals, mobile applications, membership tools, referral and care-coordination tools, communications, billing features, and related services that link to this policy (collectively, the “Service”).
This policy does not govern the independent privacy practices of health care providers, pharmacies, laboratories, employers, sponsors, attorneys, payment processors, or other third parties. Their privacy notices apply to information they control.
2. Information we collect
The information we collect depends on how you interact with the Service and may include:
- Identity and contact information: name, date of birth, postal address, email address, telephone number, account identifiers, and authentication information.
- Enrollment and eligibility information: membership selection, employer or sponsor, dependent information, eligibility status, enrollment dates, and program participation.
- Health and referral information: health conditions, medications, prescriptions, provider information, referral documents, treatment-related communications, care-coordination information, and files you or an authorized person submit.
- Transaction information: plan, charge, invoice, payment status, and related records. Payment-card or bank details may be collected directly by a payment processor rather than stored by TexMed.
- Communications and content: messages, emails, support requests, call notes, feedback, uploaded documents, and other information you provide.
- Device and usage information: IP address, browser or device type, operating system, pages or features used, timestamps, referring pages, approximate location derived from IP address, and diagnostic or security events.
- Cookie and similar-technology information: session, preference, authentication, security, and analytics data, where used.
Please provide information about another person only when you have legal authority or that person’s permission.
3. Sources of information
We may obtain information directly from you and from authorized representatives, family members, employers or program sponsors, health care providers, pharmacies, laboratories, attorneys, referral sources, payment processors, communications providers, service providers, and integrations you direct us to use. We may also collect device and usage information automatically when you use the Service.
4. How we use information
We may use personal information to:
- provide, administer, personalize, and support the Service;
- create and secure accounts and verify identity, authority, or eligibility;
- process referrals, coordinate requested services, route documents, and communicate with authorized participants;
- administer memberships, transactions, invoices, payments, cancellations, and customer support;
- send service, security, enrollment, payment, and other operational communications;
- detect, investigate, and prevent fraud, misuse, security incidents, and unlawful activity;
- maintain, troubleshoot, analyze, and improve the Service;
- create aggregated or de-identified information where permitted by law;
- comply with legal, regulatory, contractual, recordkeeping, and reporting obligations; and
- establish, exercise, or defend legal claims and protect users, TexMed, and others.
Where consent is required, we will process the information based on the consent presented at collection. We do not use health information for targeted advertising or sell health information for monetary consideration unless separately disclosed and lawfully authorized.
5. How we disclose information
We may disclose personal information as reasonably necessary and permitted by law:
- At your direction: to people and organizations you ask us to contact or authorize to receive information.
- For requested services: to providers, pharmacies, laboratories, care coordinators, referral sources, employers, sponsors, attorneys, or other participants involved in providing or administering a requested service.
- To service providers: to hosting, communications, security, analytics, document-processing, customer-support, and payment vendors that perform services for us under applicable restrictions.
- For legal and safety purposes: when required by law or reasonably necessary to protect rights, safety, security, users, or the Service; respond to lawful process; or investigate fraud or misconduct.
- For a business transaction: in connection with a proposed or completed merger, financing, reorganization, sale, or transfer, subject to appropriate protections.
- With consent: for another purpose disclosed when permission is requested.
We may disclose aggregated or de-identified information where it cannot reasonably be used to identify an individual, subject to applicable law.
6. Health information, HIPAA, and breach notices
Whether the Health Insurance Portability and Accountability Act (“HIPAA”) applies depends on the information, service, and relationship among TexMed, a health care provider, and other participants. When TexMed acts as a HIPAA covered entity or business associate, applicable protected health information will be handled under HIPAA, any required business associate agreement, and the applicable Notice of Privacy Practices.
This Privacy Policy does not replace a Notice of Privacy Practices or a patient authorization. Where HIPAA does not apply, other federal or state privacy and breach-notification laws may apply to health-related information. We will provide notifications following a qualifying breach as required by applicable law.
7. Cookies and similar technologies
The Service may use cookies, local storage, software development kits, pixels, or similar technologies for authentication, session continuity, preferences, security, performance, and analytics. Available browser or device controls may allow you to limit some technologies, but disabling required storage may prevent parts of the Service from working.
Before publication, TexMed must confirm the exact analytics, advertising, session-replay, and tracking technologies used on every public page, login page, portal, and mobile app.
8. Data retention
We retain personal information for as long as reasonably necessary to provide the Service, maintain required business and health records, complete transactions, address disputes, enforce agreements, meet legal and regulatory requirements, and protect security. Retention periods vary by the type of information and applicable obligations. We may retain aggregated or de-identified information where permitted by law.
9. Information security
We use administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, use, alteration, and disclosure. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
Protect your credentials and devices, sign out of shared devices, and report suspected unauthorized access or security incidents to referrals@texmedhealth.com.
10. Your privacy rights and choices
Depending on your relationship with TexMed, where you live, and applicable exceptions, you may have the right to request access to, correction of, deletion of, or a portable copy of personal information; to opt out of certain sales, targeted advertising, or profiling; and to appeal a denied privacy request.
Submit a request to referrals@texmedhealth.com with the subject line “Privacy Request.” Describe the right you wish to exercise and the account or service involved. We may verify your identity and authority before acting. An authorized agent may submit a request when permitted by law, but we may require proof of authorization.
We will respond within the period required by applicable law. Certain information may be exempt, and some requests may be limited by health-record, transaction, security, fraud-prevention, legal-retention, or other obligations. If protected health information is governed by a Notice of Privacy Practices, use the process in that notice to exercise HIPAA rights.
You may unsubscribe from marketing email using the instructions in the message. You may still receive non-marketing communications concerning your account, transactions, care coordination, legal notices, or security.
11. Children and dependent information
The Service is not directed to children under 13 for independent use. A parent, guardian, or other authorized adult may provide information about a child or dependent when permitted by law and the applicable program. If you believe a child provided information without appropriate authorization, contact us so we can review the matter.
12. Third-party services
The Service may contain links to or integrations with third-party websites, applications, providers, pharmacies, laboratories, payment processors, or communications services. Their privacy policies govern their processing, and TexMed does not control their independent practices. Review their notices before providing information directly to them.
13. Changes to this policy
We may update this Privacy Policy to reflect changes in the Service, our practices, or legal requirements. The “Last updated” date identifies the latest revision. If changes materially affect privacy rights, we will provide notice as required by law.
